Terms of Service

1. Acceptance of Terms

By accessing or using Fly Vantage AI ("Service"), operated by Fly Vantage AI, LLC ("Fly Vantage," "we," "us"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

2. Service Description

Fly Vantage AI provides an AI-powered operating platform for Part 135 private jet charter operators, including website hosting, AI voice receptionist, flight management, crew dispatch, quoting, invoicing, and billing tools. The platform also includes email and SMS notification services for operational communications.

3. Account Registration

To access the platform, you must create an account and provide accurate, current information including your name, email address, phone number, and business details. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

4. Pricing & Billing

Monthly plans are billed at $999/month (currently $799/month with introductory pricing). Annual plans are $9,450/year. All plans include every feature with no per-seat fees. Payments are processed securely through Stripe. You authorize us to charge your payment method on a recurring basis.

5. Cancellation & Refunds

You may cancel your subscription at any time — you're not locked into a contract and there are no cancellation fees. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial months or unused portions of annual plans.

6. SMS/Text Messaging Terms

By providing your mobile phone number and opting in to receive text messages, you agree to the following:

• You consent to receive SMS/text messages from Fly Vantage AI related to support ticket updates, operational notifications, booking confirmations, and account alerts.
• Message frequency varies based on your account activity.
• Message and data rates may apply. Check with your mobile carrier for details.
• You may opt out at any time by replying STOP to any message.
• For help, reply HELP or contact support@flyvantage.ai.
• Your mobile information will not be shared with third parties for marketing purposes. See our SMS Privacy Policy for details.

Opting out of SMS does not cancel your subscription or account. You will continue to receive email notifications.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to our systems or other users' accounts
• Transmit malicious code, viruses, or harmful data
• Use the Service to send unsolicited commercial messages (spam)
• Misrepresent your identity or affiliation with any person or organization

8. Intellectual Property

The Fly Vantage AI platform, including its design, code, features, and documentation, is the property of Fly Vantage AI, LLC. Your subscription grants you a non-exclusive, non-transferable license to use the platform for your charter operation. Content you create (client data, quotes, invoices) remains your property.

9. Limitation of Liability

The Service is provided "as is" without warranties of any kind. Fly Vantage AI, LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

10. Operational Control Disclaimer

Fly Vantage AI is a technology platform. We do not operate aircraft, hold operating certificates, or exercise operational control over any flight. All flight operations, crew qualifications, maintenance compliance, and safety decisions remain the sole responsibility of the Part 135 certificate holder. Nothing in this Service creates an agency, partnership, or joint venture between Fly Vantage and any operator.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or platform notification. Continued use of the Service after changes constitutes acceptance of the revised terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles.
